2. Collection and Storage of Personal Data, and the Nature and Purpose of Its Use

2.1 Hosting

This website is hosted by 1&1 IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany (“IONOS”). IONOS processes the data generated when the website is accessed on our behalf (data processing under Article 28 GDPR), in particular the server log files described in section 2.2. We have entered into a data processing agreement with IONOS. As IONOS is based in Germany, no transfer to a third country takes place.

Legal basis: Article 6(1)(f) GDPR (legitimate interest in the secure and reliable operation of the website).

2.2 When Visiting the Website

When you access our website, information is automatically sent by your browser to our server, or to the server of our hosting provider (see section 2.1). These so-called server log files contain:

1.      IP address

2.      date and time of the request

3.      browser type and version

4.      referrer URL

5.      access status / HTTP status code

6.      amount of data transferred

This data is used exclusively to ensure the smooth operation of the website, to optimize our offering, and to ensure security. This data is not combined with other data sources.

2.3 Contact Form / Email Contact

If you send us inquiries via the contact form or by email, the details you provide in the inquiry form or email, including the contact details you provide there, are stored by us for the purpose of processing your inquiry and in case of follow-up questions. We do not pass on this data without your consent.

2.      Article 6(1)(f) GDPR (legitimate interest in processing the inquiry)

2.4 Newsletter (MailerLite)

If you wish to subscribe to our newsletter, we require an email address from you as well as confirmation that you agree to receive the newsletter. Registration takes place using the so-called double opt-in procedure: after you sign up, you will receive a confirmation email in which you must expressly confirm your subscription by clicking a link. Only after this confirmation will you be added to our distribution list; this process is logged.

We use the service “MailerLite”, provided by MailerLite Limited, Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland, to send our newsletter. The data you provide upon subscribing (email address, time of subscription, IP address) is stored and processed on MailerLite’s servers. We have entered into a data processing agreement with MailerLite. As part of the newsletter dispatch, MailerLite may also analyze open and click rates in order to optimize delivery.

You may withdraw your consent at any time with future effect, e.g. via the unsubscribe link at the end of every newsletter. The lawfulness of processing carried out prior to the withdrawal remains unaffected.

Legal basis: Article 6(1)(a) GDPR.

2.5 Payment Processing (Stripe)

We use the payment service provider Stripe to process payments for bookings and orders. Stripe is operated by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, and, where applicable, its US parent company Stripe, Inc. As part of payment processing, the data required for this purpose (e.g. name, payment amount, payment method, bank details or card data) is transmitted to Stripe. We ourselves do not have access to complete payment data.

Where, in individual cases, data is transferred to Stripe, Inc. in the United States, this transfer is based on the Standard Contractual Clauses approved by the European Commission (Article 46(2)(c) GDPR) and, where applicable, the EU-U.S. Data Privacy Framework.

Legal basis: Article 6(1)(b) GDPR (performance of a contract).

2.6 Live Sessions via Video Conference (Zoom)

For live sessions as part of coaching and group programs, we use the video conferencing service Zoom, provided by Zoom Video Communications, Inc., 55 Almaden Boulevard, 6th Floor, San Jose, CA 95113, USA. This involves the processing of, among other things, your name, email address, IP address, and audio/video during the session, provided you activate your camera and microphone. Live sessions are only recorded with prior notice to, or the consent of, participants.

Zoom processes certain data (so-called operational data) in the United States. This transfer is based on the Standard Contractual Clauses approved by the European Commission (Article 46(2)(c) GDPR). We have entered into a data processing agreement with Zoom.

Legal basis: Article 6(1)(b) GDPR (performance of a contract), alternatively Article 6(1)(f) GDPR.

2.7 Cookies

Our website does not use cookies that are not necessary for its functionality. For cookies that are not technically necessary (e.g. analytics or marketing cookies), we obtain your consent in advance via a consent banner.

Legal basis for technically necessary cookies: Article 6(1)(f) GDPR in conjunction with Section 25(2) TDDDG (Telecommunications-Digital-Services-Data-Protection Act, formerly TTDSG).

Legal basis for all other cookies: Article 6(1)(a) GDPR in conjunction with Section 25(1) TDDDG.

If external services such as Google Analytics, the Facebook Pixel, or other tracking tools are integrated, we will inform you separately and, where required, obtain your consent.

3. Disclosure of Data to Third Parties

Your personal data will only be disclosed to third parties if:

1.      you have expressly consented,

2.      disclosure is necessary to perform the contract (e.g. to the service providers named in section 2 – IONOS, MailerLite, Stripe and Zoom – with each of whom a data processing agreement is in place), or

3.      we are legally obliged to do so.

4. Your Rights

You have the right to:

1.      obtain information about your personal data stored by us pursuant to Article 15 GDPR,

2.      request the prompt correction of inaccurate data pursuant to Article 16 GDPR,

3.      request the deletion of your data pursuant to Article 17 GDPR, insofar as no statutory retention obligation exists,

4.      request the restriction of processing pursuant to Article 18 GDPR,

5.      receive your data in a structured, commonly used and machine-readable format, or have it transmitted to a third party, pursuant to Article 20 GDPR,

6.      object at any time, on grounds relating to your particular situation, to processing of your data based on Article 6(1)(f) GDPR pursuant to Article 21 GDPR; this also applies to profiling based on this provision. Following an objection, we will no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests,

7.      lodge a complaint with a supervisory authority pursuant to Article 77 GDPR.

5. Retention Period

We store personal data only for as long as necessary for the purposes of processing, or as long as statutory retention periods apply. In particular, invoicing data is subject to statutory commercial and tax retention periods of generally 6 to 10 years (Section 257 of the German Commercial Code (HGB), Section 147 of the German Fiscal Code (AO)); such data is retained for the duration of the applicable period even after the original purpose of processing has ceased to apply.

Our website uses SSL encryption to ensure the security of your data during transmission.
